Terms of Service

These Terms of Service ("Terms") govern your use of the NCMS MyPath platform at ncmassageschool.net ("MyPath" or "the Service"), operated by NC Massage School ("NCMS", "we", "us", or "our"). By accessing or using MyPath, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

1. Description of the Service

MyPath is an institutional system used to support NC Massage School's massage therapy training program. The Service provides applicant registration, the admissions questionnaire, enrollment agreement workflows, student records, attendance and clock-hour tracking (in development), transcript records (in development), administrative financial recordkeeping, and related institutional functions for current and prospective students, faculty, and administrative staff.

2. Eligibility

You must be at least 18 years old to use the Service. The Service is intended for institutional users (applicants, students, faculty, and staff) of NC Massage School. By using the Service, you represent that you meet these eligibility requirements.

3. Account model

Public registration is open and does not require an account. Authenticated access to MyPath beyond registration (including the enrollment agreement workflow and student portal) requires:

  • A valid invitation issued to you by NC Massage School, and
  • Sign-in with a supported third-party identity provider (currently Google).

MyPath does not maintain your password — sign-in is delegated to the identity provider you choose. You are responsible for keeping your identity-provider credentials secure. You must not share your account or attempt to use an invitation issued to another person. We reserve the right to suspend or revoke access for misuse.

4. Your responsibilities

  • Provide accurate, complete, and current information in your application, questionnaire, enrollment agreement, and any uploads.
  • Keep your contact information current so we can reach you with administrative communications.
  • Complete the enrollment agreement honestly and with the understanding that your electronic signature is legally binding.
  • Use the Service only for its intended institutional purposes — not for any unlawful or unauthorized purpose.
  • Do not attempt to access another student's records, bypass security controls, scrape data, probe the Service, or interfere with its normal operation.

5. NCMS's responsibilities

  • Operate the Service with reasonable care and security.
  • Process your information consistent with the Privacy Policy.
  • Generate and preserve institutional records (enrollment agreements, attendance, transcripts) as required by program policy and applicable regulation.
  • Communicate with you about your application, enrollment, and active student status.

6. Enrollment agreement

When you complete the authenticated enrollment agreement workflow on MyPath, the agreement is electronically signed by you and countersigned by an authorized NCMS representative. Once both parties have signed, the agreement is a legally binding contract between you and NC Massage School describing the program of enrollment, official program dates, tuition, and policies in effect at sign time. The signed agreement is preserved as the immutable institutional record. Any amendment requires an explicit written amendment process; the agreement cannot be modified informally through the Service.

7. Payment terms

Tuition, fees, and payment plans are governed by the enrollment agreement and the NC Massage School catalog in force at the time you enroll. The following operational rules apply to administrative recordkeeping in MyPath:

  • Payments are processed outside MyPath. MyPath records charges, payments, credits, and balances for administrative tracking, invoices, and receipts. Submitting payment information to MyPath is not the same as making a payment.
  • The $1,200 enrollment deposit is non-refundable. Refunds for other amounts, if any, are governed by the enrollment agreement and applicable law.
  • Standard new-student charges and the schedule on which they are due are described in your acceptance materials and in the enrollment agreement.

8. Intellectual property

The Service, including its design, code, branding, and the NC Massage School marks, is the property of NC Massage School and its licensors. Course materials, policies, and other institutional content are the intellectual property of NC Massage School or the respective rights-holders. You receive a limited, non-transferable, revocable license to use the Service for your institutional purposes during your relationship with NCMS. You may not copy, redistribute, or repurpose the Service or its content outside that purpose.

9. Termination

You may stop using the Service at any time. NCMS may suspend or terminate your access to the Service if you violate these Terms, the enrollment agreement, program policies, or applicable law, or if your relationship with NCMS ends. Termination of access does not delete institutional records that NCMS is required to retain by educational recordkeeping obligations.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or availability. NCMS does not warrant that the Service will be uninterrupted, error-free, or free from harmful components.

Enrollment in or completion of the NC Massage School program does not guarantee licensure, employment, salary, or any other particular outcome. Licensure decisions are made by the North Carolina Board of Massage and Bodywork Therapy and other applicable authorities.

11. Limitation of liability

To the maximum extent permitted by law, NCMS and its officers, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our aggregate liability arising out of these Terms or your use of the Service will not exceed the amount you have paid (if any) to NCMS for use of the Service in the twelve months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.

12. Third-party services

The Service relies on third-party providers including Microsoft Azure (hosting), Twilio SendGrid (email delivery), and Google (sign-in). Your use of those services is governed by their own terms and privacy policies. NCMS is not responsible for the acts or omissions of third-party providers.

13. Governing law

These Terms are governed by the laws of the State of North Carolina, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Service will be brought exclusively in the state or federal courts located in North Carolina, and you consent to personal jurisdiction in those courts.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the "Effective date" at the top of this page. Continued use of the Service after a change constitutes acceptance of the updated Terms.
